These Terms & Conditions (“Terms”) govern your use of the website thegrovenyc.org (the “Site”) and your participation in classes, workshops, and excursions offered by The Grove, a program of Big Apple Coaching LLC (“Big Apple Coaching,” “we,” “us,” or “our”). By using this Site or registering for a class, you agree to these Terms.
About The Grove
The Grove is a community classes and workshops program operated by Big Apple Coaching LLC, a limited liability company organized under the laws of the State of New York.
The Grove offers community classes for adult personal enrichment. Our classes are non-credit-bearing and are not part of any accredited degree program. Participation does not result in academic credit, professional licensure, or certification, and is not a substitute for formal academic, vocational, or professional education. The Grove is not an accredited educational institution.
Registration & Enrollment
All classes require registration in advance. We do not accept walk-ins or unregistered participants.
Registration is by the month. You choose the months you want and pay for those months; there is no requirement to register for a whole term. Your place is confirmed when your payment is processed, or — if you are registering by email — when we confirm it to you in writing.
You may also join a month that is already under way, if there is space. The register buttons on each class page charge for a whole month, so a mid-month start is arranged by email: write to hello@thegrovenyc.org and we will charge you only for the sessions remaining in that month, at the class’s per-session rate.
Class sizes are limited. We reserve the right to close registration when a class reaches capacity. We may also cancel or reschedule a session or an entire class due to low enrollment, instructor availability, or other circumstances. If we do, you will be notified and refunded for any session you paid for that does not take place. See our Refund & Cancellation Policy for the details.
Eligibility
Our classes are open to the public and are designed for adults. Certain classes may have age recommendations or other guidelines noted in the class description. By registering, you confirm that you (or the person you are registering) meet any stated eligibility criteria.
You may register on someone else’s behalf. If you do, our Liability Waiver & Assumption of Risk sets out what you are agreeing to for them, and asks you to confirm that you have the authority to do so.
Payment
We accept payment by credit or debit card, processed through Stripe. Payment is due at the time of registration unless we have agreed otherwise in writing. Card details go to Stripe directly and are never stored on our servers.
Published rates are per person, per session. A month’s price is that rate multiplied by the number of sessions the month holds, which is why months differ in price. Current rates and monthly totals are published on each class page.
Class Conduct
We are committed to maintaining a welcoming, respectful, and safe learning environment. Participants are expected to treat fellow participants, instructors, and staff with courtesy and respect. We reserve the right to remove any participant whose behavior is disruptive, threatening, or inconsistent with a safe and respectful learning environment. In such cases, refunds will be issued at our discretion. A removal for conduct is not a cancellation by The Grove, and the full refund our Refund & Cancellation Policy provides for a class or month we cancel does not apply to it.
Excursions & Guests
Classes may include excursions to museums, cultural institutions, government offices, public spaces, and other sites in New York City, and may include visiting guests. Excursions and guests are intentions for a term rather than guarantees — they depend on scheduling and on the group. Class meets at its regular time and place whether or not an excursion takes place.
Participation in any excursion is voluntary. Participants are responsible for their own transportation to and from excursion sites unless we say otherwise. If an excursion carries an admission fee, we will either cover it or tell you the cost in advance; you will not be charged for an excursion without notice.
Intellectual Property
All class materials, curricula, handouts, presentations, and content created by The Grove and Big Apple Coaching LLC are the intellectual property of Big Apple Coaching LLC and may not be reproduced, distributed, or used for commercial purposes without our written permission.
Website Use
The content on this Site is provided for informational purposes. We make reasonable efforts to keep the information accurate and up to date but do not guarantee the completeness or accuracy of any information on the Site. Class descriptions, schedules, pricing, and availability are subject to change.
Limitation of Liability
To the fullest extent permitted by law, Big Apple Coaching LLC, its owners, employees, instructors, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your participation in any class, workshop, or excursion, or your use of this Site.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the State of New York, County of New York.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the Site or participation in our classes after changes are posted constitutes acceptance of the revised Terms.
